Terms and Conditions
 
1. Scope

These terms and conditions cover the contractual relationship between Bella Sugar Craft (hereinafter referred as “BSC”) and the purchaser (hereinafter referred to as “customer”) of any products or services offered through the website of BSC and the associated Online Shop. No other terms or conditions are valid unless agreed in writing. Once an order is entered, the customer is deemed to have accepted the terms and conditions published on www.bellasugarcraft.com.

 

2. Prices

All prices are either in Tanzanian Shillings (TS) or Swiss francs (CHF) as indicated for the corresponding article, but can be subject to errors and adjustments by BSC.

 

3.1. Ordering of Products

Products featured online represent a formal offer by BSC but not a binding contract. However, a contract is created when a customer clicks the “Confirm Order” button, leading to a formal order of the product(s) or service(s) placed in the shopping cart and once BSC confirmed the order. Confirmation of receipt of the order follows by email shortly afterwards. In case an item is sold out or a service is booked out, BSC reserves the right to cancel the order.

3.2. Booking of Classes

Customers may book classes on the webpage of BSC. BSC will confirm the booking of classes as soon as possible subject to available free seats per class. 

One week before class begin BSC will provide additional information such as location, start and end times of the class. 

At least 50% of training class fees have to be paid not later than 2 (two) weeks before beginning of the class. The full amount of the class fee has to be paid before the beginning of the class. BSC reserved the right to deny access to the classroom if the fees are not paid accordingly.

If participation to a class had to be cancelled by the customer, BSC reserves the right retain the down payment if the cancellation occurred within 1 (one) week before class begin.

BSC reserves the right to cancel a class and in this unlikely event will inform customers as soon as possible. In this case, paid fees will be paid back as soon as possible but BSC does not accept any further legal or financial claims by customers.

Participation to the class is at customers risk and customers have to make sure that they are sufficiently ensured in case of injuries. BSC will not be liable in case of accidents during training classes or related thereto.

 

4. Delivery

Ordered items are delivered as quickly as possible, according to availability. Partial shipments are possible. Completion deliveries are shipped free of charge.

 

5. Shipment and insurance

Shipping costs depend on the location of delivery and weight of the purchased items. Deliveries from Switzerland are handled by Swiss Post. Deliveries within Tanzania are handled individually as per agreement between customer and BSC.

Deliveries to a customer-defined location are handled at the customer’s risk and expense. BSC arranges shipping insurance only if a customer specifies this requirement in writing. Deliveries are offered within Switzerland and worldwide. 

Shipping costs within Switzerland:

0-2kg: CHF 2.35 - 9.00 depending on exact size and weight

2-5kg: CHF 11

5-10kg: CHF 13

10-20kg: CHF19

20-30kg: CHF29

Pick up is possible upon coordination with BSC

Shipping costs outside Switzerland and Tanzania are subject to individual prices and conditions which the customer is asked to request by BSC. 

 

6. Guarantee

If applicable BSC extends a guarantee in accordance with the warranty terms of the original manufacturer of the goods. Visible defects must be communicated in writing by the customer within 5 (five) days of delivery of the product. Otherwise, the delivery will be regarded as accepted.

 

7. Exchange

Wrongly ordered goods can be exchanged subject to prior agreement with BSC within 14 (fourteen) days and must be returned unused and in their original wrapping. The customer bears the mailing costs.

 

8. Payment

Payments must be paid in full before shipments of the products using the available payment methods mentioned on BSC website.

If the applicable payment deadlines are not met, BSC may cancel the customer's subsequent order. 

BSC will deliver only on condition of an advance payment or as agreed between customer and BSC. 

BSC may cancel an order if the customer is not creditworthy, if he/she has one or several outstanding invoices at BSC or if BSC has reasons to believe that the order is placed with intent to defraud.

 

9. Reservation of ownership

The goods remain the property of BSC until payment is made in full. A reminder fee of 5% of the ordered value will be charged after the second payment reminder.

 

10. Liability

As far as is legally permissible, BSC assumes no liability for the improper handling or use of any of the products sold by BSC or skills acquired by training classes offered by BSC. 

Participation to the class is at customers risk and customers have to make sure that they are sufficiently ensured in case of injuries. BSC will not be liable in case of accidents during training classes or related thereto.

 

11. Area of jurisdiction

Any legal proceedings between BSC and the customer are subject exclusively to Swiss law. The court of jurisdiction for any claims relating to the contract is Zürich. If any clauses of these Terms & Conditions are not correct or not applicable, the remaining clauses will be still valid.
